Welcome to KidSplit, Inc. ("KidSplit," "we," "our," or "us"). By using our website and services, you agree to these Terms of Service. If you do not agree, please do not use KidSplit.
1. About KidSplit
KidSplit, Inc. is a guided online platform that helps parents create custody agreement drafts and understand how their preferences align through tools such as the Custody Match Report.
KidSplit is not a law firm and does not provide legal advice. All information, guidance, and draft agreements or reports generated are for informational purposes only and may not be enforceable in court without additional legal steps.
2. No Legal Advice
All content, tools, and results provided by KidSplit, Inc., including the Custody Match Report, are for informational purposes only. Nothing on this site should be considered legal advice. You should consult a qualified attorney for advice specific to your situation.
3. Legal Binding of Agreements
Agreements created using KidSplit, Inc. are drafts. To make them legally binding, you must file them with your local family court and obtain court approval. Laws vary by state.
4. Custody Match Report
The Custody Match Report is a comparison tool that highlights areas of agreement and disagreement between two parents based on their responses to custody-related questions.
Each parent may view general areas of alignment for free and may purchase individual access to unlock the other parent's detailed answers.
Payment provides viewing access only. You may not share, copy, or distribute the content of the report.
By participating in the Custody Match Report, both parents consent to their responses being used to generate the shared comparison and to being made available to the other parent once that parent completes payment.
The Custody Match Report is for informational and educational purposes only. It is not legal advice, mediation, or counseling, and it does not create any legal relationship or obligation between parents.
5. Eligibility
You must be at least 18 years old to use KidSplit, Inc.
6. Accounts and Information You Provide
You agree to provide accurate and truthful information. You are responsible for any information submitted through your account.
7. Payment Processing
Payments are processed securely by Stripe. KidSplit, Inc. does not store your payment card details on our servers.
8. Data Retention and Privacy
We collect and store limited information such as email addresses, custody selections, and responses necessary to generate custody drafts and the Custody Match Report.
By using the Custody Match Report, both parents agree that their answers may be shared with the other parent once both have participated.
Data remains in our database for as long as needed to provide the service and comply with our legal obligations. You may request deletion of your data by contacting us at hello@kidsplit.com.
We do not collect or store children's names, exact ages, or dates of birth.

9. Marketing and Partner Offers
From time to time, KidSplit, Inc. may send you updates or promotional messages about our services or offers from trusted partners. These communications will always be sent directly by KidSplit, Inc., and we will never give your personal information to a partner unless you explicitly agree. You can opt out at any time by following the unsubscribe link in our emails or contacting us at hello@kidsplit.com.
10. Limitation of Liability
To the maximum extent permitted by law, KidSplit, Inc. and its officers, directors, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits or revenues, whether incurred directly or indirectly.
KidSplit, Inc. makes no warranties regarding the accuracy, completeness, or reliability of any draft agreement or Custody Match Report. The information provided is generated based on user input and should not be relied upon as professional, legal, or mediation advice. KidSplit, Inc. does not mediate, negotiate, or resolve disputes between parents.
In no event shall KidSplit, Inc.'s total liability for any claims relating to your use of the service exceed the greater of (a) the amount you paid for the service in the twelve (12) months preceding the claim, or (b) fifty U.S. dollars (US $50).
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT. YOU USE THE SERVICE AT YOUR OWN RISK.
11. Changes to the Terms
We may update these Terms at any time. Updates will be posted on this page with a revised date.
12. Arbitration & Governing Law
Any dispute, claim, or controversy arising out of or relating to your use of KidSplit, Inc. or these Terms shall be resolved exclusively through binding arbitration administered by the American Arbitration Association ("AAA") under its Commercial Arbitration Rules then in effect.
Arbitration will be conducted on an individual basis in San Diego County, California, before a single arbitrator. You and KidSplit, Inc. waive any right to a trial by jury. The laws of the State of California shall govern these Terms, without regard to conflict-of-law principles.
13. Class Action Waiver
You and KidSplit, Inc. agree that any claims or disputes will be brought only in your individual capacity, and not as a plaintiff, class member, or representative in any purported class, collective, consolidated, or representative proceeding.
14. Limitation on Claims
Any claim or cause of action arising out of or related to your use of KidSplit, Inc. or these Terms must be filed within one (1) year after such claim arose, regardless of any statute or law to the contrary. Otherwise, such claim is permanently barred.
